What You Need to Know About NRI Property Laws

India's FEMA regulations are NRI-friendly when it comes to residential and commercial property. Here are the key rules that govern your investment:

  • NRIs, PIOs and OCIs can purchase residential and commercial property in India without RBI approval.
  • Agricultural land, plantation property and farmhouses require special RBI permission and are generally not permitted.
  • Payment must be made through normal banking channels or from an NRE / NRO / FCNR account in Indian Rupees.
  • Repatriation of sale proceeds is permitted up to the original investment amount, subject to applicable tax compliance.
  • TDS of 20% (plus surcharge and cess) is deducted at source on property sale by an NRI — we guide you on getting a Lower Deduction Certificate.
  • Power of Attorney can be granted to a trusted representative in India to complete registration on your behalf.
